1. Introduction
Definition of Terms:
- “Provider” – SELFIX s.r.o., the owner of the application, its source code, and all related rights.
- “User” – any individual or legal entity that has purchased a license and uses the CMS application on their own website.
- “License Holder” – a user who has acquired a license to use the CMS application on a single domain, without any ownership rights to the application itself.
- “CMS Application” or “Application” – the web-based content management software system for video and photo websites, developed and maintained by SELFIX s.r.o.
By using the CMS Application (hereinafter referred to as the "Application"), you agree to these Terms and Conditions (“Terms”). Please read them carefully.
2. License and Use of the Application
By purchasing a license or using the CMS Application, the User agrees to be bound by these Terms. This agreement becomes effective immediately. The license does not represent a transfer of ownership. The User receives only the right to use the Application as defined by these Terms.
Each license is unique and associated with a single domain. It is prohibited to:
- share the license with other entities,
- use the same license on multiple domains without the Provider’s consent,
- resell or distribute the CMS Application together with an active license to any third party.
Any violation of these rules may result in permanent license termination without a refund.
It is not allowed to embed the content of the CMS Application in iframes or to alter the visual design of the application without prior written consent from SELFIX s.r.o.
The CMS Application is delivered without any content – it is a technical, installed software prepared for use by the website administrator. Due to its technical nature, no refunds are offered after the license is purchased.
The CMS Application is licensed to you as a non-exclusive, non-transferable, and revocable license to use the Application solely for the management of your website. The license is valid for one domain. You agree not to:
- Resell, distribute, or sublicense the Application without express consent.
- Modify, reverse engineer, or attempt to extract the source code.
- Use the Application for illegal or unauthorized purposes.
- Make any changes to the backend, frontend, themes, or plugins without the express consent of the application owner SELFIX s.r.o.
3. User Responsibilities
Changing the domain, migrating to another server, or transferring the license to another person is possible only upon agreement with the Provider and for an additional fee. The Application must be installed on a server that meets the technical requirements stated in the documentation. The Provider is not liable for any issues caused by installation on an incompatible server.
The Provider reserves the right to deny a license to entities that previously violated the Terms or are reasonably suspected to intend to do so.
The User agrees not to use the Application to distribute illegal, hateful, discriminatory, or otherwise inappropriate content.
The License Holder is fully responsible for all content, including comments, on websites using the Application. This responsibility arises at the moment of license purchase.
As a User, you acknowledge your responsibility for:
- Complying with all applicable laws and regulations, including intellectual property laws and GDPR.
- Ensuring the confidentiality of your login credentials and immediately informing the Provider about any unauthorized access.
- Ensuring that the content of your website does not violate any third-party rights or applicable laws.
4. Intellectual Property
All content, trademarks, service marks, and intellectual property rights related to the Application remain the exclusive property of the Provider. Any unauthorized use, copying, modification, or distribution of these elements is strictly prohibited.
5. Data Protection and Privacy
The CMS Application complies with applicable data protection laws, including the GDPR. Users must ensure that their use of the Application complies with their local data protection obligations.
6. Support and Updates
Support is provided based on the selected license model. Updates and improvements are available to Users with active update access, based on their license setup or purchased service.
7. Third-Party Integrations
The Application may include integrations with third-party services. The Provider is not responsible for the performance, accuracy, or availability of such third-party services.
8. Limitation of Liability
Use of the CMS Application is entirely at the User's own risk. The Provider accepts no liability for damages resulting from misuse, incompatibility with the server, outages, or software errors.
The Application is provided “as is” and “as available,” without any warranties. The Provider expressly disclaims all direct, indirect, incidental, special, or consequential liabilities, including loss of profit, data, or business interruption. In cases where full exclusion of liability is not permitted by applicable law, the Provider’s liability shall be limited to the amount paid by the User for the license.
9. Termination
The Provider reserves the right to terminate this Agreement immediately and block access to the Application in case of any breach of these Terms.
The User may terminate the agreement at any time by deleting the Application and all its copies, modifications, and components. Upon termination, the right to use the Application shall immediately cease.
10. Governing Law and Jurisdiction
These Terms are governed by and interpreted in accordance with the laws of the Slovak Republic. Any disputes arising under these Terms will be subject to the jurisdiction of Slovak courts.
11. Changes to the Terms
These Terms may be updated periodically. Users will be notified of significant changes via email or within the Application. Continued use after such changes constitutes acceptance of the updated Terms.
12. Plugins
Plugins sold with or alongside the CMS Application are considered part of the CMS and are subject to the same Terms of Use.
